Official Terms and Conditions
NO PURCHASE NECESSARY TO ENTER OR WIN. A PURCHASE WILL NOT INCREASE YOUR CHANCES OF WINNING.
1. Promotion Period
The Graeter's "Year of Ice Cream" Derby Giveaway (the "Giveaway") begins on April 1, 2026 at 12:00 AM Eastern Time ("ET") and ends on May 2, 2026 at 11:59 PM Eastern Time (the "Promotion Period").
2. Sponsor
This Giveaway is sponsored by The Graeter Manufacturing Company, 1175 Regina Graeter Way, Cincinnati, OH 45204 ("Sponsor" or "Graeter's").
3. Eligibility
No purchase necessary to enter or win. This Giveaway is open to legal residents of the forty-eight (48) contiguous United States (excluding Hawaii and Alaska) who are eighteen (18) years of age or older as of the date of entry. Employees, officers, directors, agents, and representatives of Sponsor, its parent companies, subsidiaries, affiliates, promotional agencies, and members of their immediate families (spouse, parents, children, siblings and their respective spouses) and persons living in the same household as such individuals (whether related or not) are not eligible to enter or win. This Giveaway is void where prohibited by law.
4. How to Enter
To enter, visit graeters.com/derby during the Promotion Period and complete the entry form, or enter by mail as described below. There are three (3) ways to enter:
Method 1: Email Entry (1 Entry)
Complete the online entry form by providing your first name, last name, and valid email address. By submitting the form, you agree to receive marketing emails from Graeter's. You will receive one (1) entry into the Giveaway.
Method 2: SMS Opt-In (+1 Additional Entry)
When completing the online entry form, also provide your mobile phone number to opt in to SMS communications from Graeter's. This will earn you one (1) additional entry for a total of two (2) entries when combined with Method 1.
Method 3: Mail-In Entry (1 Entry)
To enter without any online submission or marketing opt-in, hand-print your first name, last name, mailing address, email address, and phone number on a 3" x 5" card and mail it in a stamped envelope to: Graeter's Derby Giveaway Entry, 1175 Regina Graeter Way, Cincinnati, OH 45204. Mail-in entries must be postmarked by May 2, 2026 and received by May 9, 2026. A valid mail-in entry will receive one (1) entry. No marketing consent is required for mail-in entries. Mail-in entrants will not receive marketing communications unless they separately opt in.
Entry Limitations:
- Only one (1) entry per person per household via any combination of Methods 1 and 2, and one (1) mail-in entry per person per household, during the entire Promotion Period.
- Multiple entries submitted by anyone other than the eligible entrant are void.
- Use of automated entry devices, programs, or scripts is prohibited.
- Sponsor is not responsible for entries that are lost, late, incomplete, illegible, or misdirected, or for any technical issues that may prevent entry.
- Sponsor is not responsible for mail-in entries that are lost, damaged, or delayed in transit.
5. Prizes
Grand Prize (1 Winner)
One (1) grand prize winner will receive a Graeter's gift card with a value sufficient to cover twelve (12) six-pint shipper orders from graeters.com (the "Grand Prize"). The gift card may be used at the winner's discretion for any purchases on graeters.com, including but not limited to six-pint shippers. The winner may choose their own flavors and order timing. Shipping costs will be covered by the gift card value.
Approximate Retail Value ("ARV") of Grand Prize: $1,019.40 (based on twelve orders at $84.95 each), plus shipping. Actual value may vary depending on shipping destination and product pricing at time of redemption.
Runner-Up Prizes (5 Winners)
Five (5) runner-up winners will each receive one (1) six-pint shipper delivered to their address. Winners will be contacted to select their preferred flavors. Shipping will be provided by Sponsor at no cost to the winner.
Approximate Retail Value ("ARV") of each Runner-Up Prize: $84.95, plus shipping.
General Prize Conditions:
- No substitution, transfer, or cash equivalent of any Prize is permitted, except at Sponsor's sole discretion.
- Sponsor reserves the right to substitute any Prize with another prize of equal or greater value.
- All federal, state, and local taxes on Prizes are the sole responsibility of each winner.
- Prizes will be shipped only to addresses within the forty-eight (48) contiguous United States.
6. Winner Selection and Notification
One (1) grand prize winner and five (5) runner-up winners will be selected in a random drawing from all eligible entries received during the Promotion Period, including valid mail-in entries. The drawing will be conducted on or about the week of May 11, 2026 by Sponsor or its designated representatives, whose decisions are final and binding.
Potential winners will be notified by email and/or phone within five (5) business days after the drawing using the contact information provided during entry. If a potential winner cannot be reached after reasonable attempts, or if a potential winner fails to respond within fourteen (14) days of the first notification attempt, such potential winner may be disqualified and an alternate winner may be selected from the remaining eligible entries.
7. Winner Verification and Prize Fulfillment
Before being declared an official winner, each potential winner may be required to:
- Complete and return an affidavit of eligibility and liability/publicity release
- Provide proof of identity and eligibility
- Comply with these Official Terms and Conditions
Grand Prize will be fulfilled within thirty (30) days after winner verification is complete. Runner-Up Prizes will be shipped after the winner provides their flavor selections and a valid shipping address within the contiguous United States.
8. Publicity Rights
By entering this Giveaway, each entrant grants Sponsor the right to use his/her name, likeness, photograph, voice, biographical information, and statements for advertising and promotional purposes in any media now known or hereafter developed, worldwide, in perpetuity, without further compensation, notification, or permission, except where prohibited by law.
9. General Conditions
By participating, entrants agree to be bound by these Official Terms and Conditions and the decisions of Sponsor, which are final and binding. Sponsor reserves the right, in its sole discretion, to:
- Disqualify any individual who tampers with the entry process or the operation of the Giveaway
- Cancel, terminate, modify, or suspend the Giveaway for any reason
- Select alternative winners if required by law or circumstances
- Interpret these Terms and Conditions
10. Limitations of Liability
By entering, entrants agree to release, discharge, and hold harmless Sponsor, and its respective parent companies, subsidiaries, affiliates, employees, officers, directors, successors, representatives, agents, and assigns from any and all liability for any injuries, losses, or damages of any kind arising from or in connection with the Giveaway or acceptance, possession, or use of any Prize.
11. Disputes
This Giveaway is governed by the laws of the State of Ohio. Any disputes arising out of this Giveaway will be resolved in the courts of Hamilton County, Ohio.
12. Data Collection and Use
Information collected from entrants will be used in accordance with Sponsor's Privacy Policy, available at graeters.com. By entering, entrants consent to the collection and use of their personal information as described in the Privacy Policy. Entrants who opt in to email and/or SMS communications may unsubscribe at any time by following the unsubscribe instructions in any message or by replying STOP to any text message.
13. Winners List
For the names of the winners, send a self-addressed stamped envelope by August 31, 2026 to: Graeter's Derby Giveaway Winners, 1175 Regina Graeter Way, Cincinnati, OH 45204.
14. Final Provisions
This Giveaway is void where prohibited by law. The invalidity or unenforceability of any provision of these Terms and Conditions will not affect the validity or enforceability of any other provision. These Terms and Conditions constitute the complete and exclusive agreement between entrants and Sponsor regarding this Giveaway.
